8th Court of Appeals rejects El Paso's bid to rehear Pickett franchise fee case

The 8th Court of Appeals has rejected El Paso's request for a new hearing in a lawsuit brought by Joe Pickett against the city, according to KVIA. The denial came Monday evening, one day after the city filed the motion for reconsideration on July 9.

The underlying dispute centers on the city's franchise fee charged on wear and tear from street maintenance trucks. In June, the appeals court ruled that the fee was unconstitutional.

With Monday's denial, El Paso's options to challenge the court's decision appear limited. The city can pursue further legal remedies, though none were immediately announced.
